Award of Compensation to Police Prosecutors by Courts

AWARD OF COMPENSATION TO POLICE PROSECUTORS BY COURTS

It has come to the attention of Her Ladyship, the Chief Justice that some Judges are continuing with the habit of awarding compensations to Police Prosecutors who appear before them.

I am directed to draw your attention to the fact that this act is not backed by law and as such no Judge should award compensation to Police Prosecutors unless a statute expressly or by necessary implication directs that to be done.

I am further directed to draw your attention to the fact that the law which empowered the courts to award costs to Police or Private Prosecutors i.e. Section 139 of Act 30 was repealed in 2002 by the Criminal Code (Amendment) Act (Act 633).

If a Judge is of the opinion that a Prosecutor should be motivated to continue his or her good work, the Judge may decide to recommend the Prosecutor to his or her employers for consideration for promotion or for merit increment.

Her Ladyship, the Chief Justice has therefore directed that the above should be brought to the attention of all Judges for compliance.
